Terms of Service

1. Acceptance of Terms

By accessing https://www.meghalayacabs.com, using our mobile application, or booking any service from Meghalaya Cabs, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform or services.

These Terms constitute a legally binding agreement between you ("Customer") and Meghalaya Cabs ("we", "us", "our"), a cab and tour service operating under the laws of India, with its principal place of business at Police Bazar, Shillong, Meghalaya – 793001, India.

2. Services Description

Meghalaya Cabs provides the following services through our Platform:

  • Private cab hire for point-to-point transfers within and from Meghalaya and Northeast India
  • Packaged tour itineraries covering destinations across Meghalaya, Assam, Arunachal Pradesh, Nagaland, Bhutan, and Nepal
  • Shared cab seat bookings for the Shillong–Guwahati corridor
  • Custom itinerary planning and driver-guided trips

All bookings are for private vehicle hire with a driver. We do not operate self-drive rentals. The driver assigned to your trip is either a verified employee or a registered partner of Meghalaya Cabs.

We reserve the right to decline any booking at our discretion without stating a reason.

3. Eligibility

  • You must be at least 18 years of age to create an account or make a booking.
  • You must provide accurate and complete information at the time of booking.
  • If booking on behalf of a group, you confirm that you are authorised to bind all passengers to these Terms.
  • You must possess a valid identification document (Aadhaar, passport, or government-issued ID) and present it upon request by the driver or our team.

4. Booking & Confirmation

Booking Process:

  1. Submit a booking request via our website form, mobile app, or WhatsApp.
  2. You will receive a Booking Reference (format: MC2026XXXXX) by email and/or WhatsApp within 2–4 hours.
  3. Your booking is confirmed only after you receive a written confirmation from us (via WhatsApp or email).

A booking request alone does not guarantee availability. We confirm bookings on a first-come, first-served basis.

Itinerary Changes: Minor changes during the trip can be made by communicating with the driver. Major changes (additional destinations, extended days) may attract additional charges and require our prior approval.

Permit Requirements: Some destinations (Arunachal Pradesh, Nagaland, Bhutan, Nepal) require special permits (ILP, Bhutan SDF, etc.). It is the customer's responsibility to obtain all required permits before the trip. We can advise but are not liable for denied entry due to missing permits.

5. Pricing & Payment

Payment Schedule: No advance payment is required. Payment is made directly to your driver — no online payment needed.

  • 50% of trip cost — paid to driver on Day 1 of your trip (at pickup)
  • 50% of trip cost — paid to driver on the last day of your trip (at drop-off)

All payments are made directly to the driver via cash or UPI.

What is included in the quoted price:

  • Driver charges for the agreed route and duration
  • Fuel for the entire journey
  • Driver's accommodation and meals during multi-day trips
  • Vehicle insurance

What is NOT included:

  • Hotel / accommodation costs for passengers
  • Passenger meals and personal expenses
  • Entry fees to tourist attractions, national parks, or wildlife reserves
  • Toll charges, parking fees, and state-border taxes (borne by the customer)
  • Guide services (available on request at additional cost)
  • Permit fees (ILP, Bhutan SDF, Nepal visas, etc.)

Accepted payment methods: Cash (INR), UPI, bank transfer (NEFT/IMPS). We do not accept international cards online. We never request payment via unofficial channels.

Prices quoted are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Prices are subject to change; the price at the time of booking confirmation applies.

6. Cancellation & Refund Policy

Cancellation terms apply to the advance deposit paid:

To cancel, contact us via WhatsApp at +91 8855853857 or email meghalayacabs@gmail.com with your booking reference. Cancellations are effective only upon our written acknowledgement.

Force Majeure: In the event of natural disasters, road closures, political unrest, extreme weather, or other circumstances beyond our control, we will work with you in good faith to reschedule or issue a partial/full credit at our discretion.

Refund Processing: Approved refunds will be processed within 7–10 business days to the original payment method.

7. Passenger Conduct

Passengers agree to:

  • Treat drivers and staff with respect and courtesy at all times
  • Refrain from smoking, consuming alcohol, or illegal substances inside the vehicle
  • Wear seat belts throughout the journey as required by law
  • Not carry goods that are prohibited by law (contraband, explosives, hazardous materials)
  • Not ask the driver to violate traffic laws, speed limits, or safety rules
  • Inform us in advance of any special needs (medical conditions, mobility requirements, child seats)

Meghalaya Cabs reserves the right to terminate a trip without refund if a passenger engages in abusive, threatening, or unlawful behaviour. Any damage caused to the vehicle by a passenger will be charged to them at full repair cost.

8. Limitation of Liability

To the maximum extent permitted by applicable Indian law, Meghalaya Cabs shall not be liable for:

  • Indirect, incidental, or consequential losses arising from use of our services
  • Loss or damage to personal baggage or belongings during the trip (we recommend travel insurance)
  • Delays caused by traffic, weather, road conditions, or government restrictions
  • Acts or omissions of third-party service providers (hotels, guides, ferry operators, etc.)
  • Denial of entry to restricted areas due to missing permits obtained by the customer
  • Personal injury or illness during the trip (covered by the vehicle's third-party insurance as required by law)

Our total aggregate liability for any claim arising from a booking shall not exceed the amount actually paid by you for that booking.

We strongly recommend that all passengers purchase comprehensive travel insurance before their trip.

9. Intellectual Property

All content on the Platform — including text, images, itineraries, route descriptions, design elements, logos, and software — is the intellectual property of Meghalaya Cabs and is protected under the Copyright Act, 1957 and other applicable Indian laws.

You may not reproduce, distribute, modify, or commercially exploit any content from our Platform without our prior written consent. Personal, non-commercial use (e.g., saving an itinerary for your trip) is permitted.

10. User Accounts

When you create an account on our Platform, you are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity that occurs under your account
  • Notifying us immediately at meghalayacabs@gmail.com if you suspect unauthorised access

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or provide false information.

You may delete your account at any time from your dashboard. Upon deletion, your personal data will be handled as described in our Privacy Policy.

11. Third-Party Services

Our Platform integrates with third-party services including Google Maps (for route planning), Google OAuth (for sign-in), WhatsApp (for communication), and Vercel (for hosting). Use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of these third-party services.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of India, including but not limited to:

  • The Indian Contract Act, 1872
  • The Consumer Protection Act, 2019
  • The Information Technology Act, 2000
  • The Motor Vehicles Act, 1988

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts at Shillong, Meghalaya, India.

13. Dispute Resolution

We encourage customers to contact us first at meghalayacabs@gmail.com or +91 8855853857 to resolve any dispute amicably within 15 days.

If a dispute cannot be resolved directly, it shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Shillong, Meghalaya. The arbitration shall be conducted in English.

You also have the right to approach the Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019 for consumer disputes.

14. Changes to These Terms

We may revise these Terms at any time. Material changes will be communicated via email (to registered users) and by updating the Effective Date at the top of this page. Your continued use of our services after such changes constitutes acceptance of the revised Terms.
